Texas marijuana cases thrown out after hemp law change

Texas lawmakers legalized hemp this past June 10, but many legal experts claim they may have decriminalized marijuana in the process.

Now, months after House Bill 1325 took effect, local attorneys claim many of their marijuana cases are getting thrown out.

“Law enforcement are at a loss for what to do. Prosecutors are at a loss for what to do,” says attorney Don Flanary.

The main problem? Hemp and marijuana are essentially identical. They look and smell the same. They are both broad classifications of the cannabis plant. The only difference is the amount of THC in each, the psychoactive chemical responsible for producing the high sensation.
